ELYRA is powered by Shopify, which enables us to provide the Services to you.

Age requirement

SECTION 5. SHIPPING AND DELIVERY
Delivery estimates
Delivery times are estimates and are not guaranteed. Delays can occur due to carriers, customs processing, weather, or events outside our control.
Risk of loss
Risk of loss passes to you when the order is handed over to the carrier, to the extent permitted by applicable law. If mandatory law in your jurisdiction provides otherwise, that mandatory law will apply.
Address accuracy
You are responsible for providing a correct and complete shipping address. We are not responsible for delivery issues caused by incorrect address details provided by you.
SECTION 6. RETURNS, HYGIENE SEAL AND WARRANTY
Returns and hygiene
Due to the intimate and hygiene nature of our products, returns are only accepted where the hygiene seal and sealed packaging remain intact, as described in our Return and Refund Policy [LINK]. If the seal is broken or packaging is opened, we cannot accept a return for health protection and hygiene reasons where permitted by law.
Warranty
We offer a 365 day warranty for manufacturing defects as described in our Return and Refund Policy [LINK]. This warranty does not affect your statutory legal guarantee rights under applicable consumer law.
SECTION 7. INTELLECTUAL PROPERTY
Ownership
The Services, including all content, design, text, graphics, images, audio, video, trademarks, logos, and software, are owned by ELYRA, Silverback Tribe, or our licensors, and are protected by intellectual property laws.
Limited license
You may use the Services for personal, non commercial use only. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any material on the Services without our prior written permission, except as necessary for normal browsing and purchasing.
Trademarks
ELYRA names, logos, and branding are trademarks of ELYRA or its licensors. Shopify is a trademark of Shopify. All other trademarks belong to their respective owners.
SECTION 8. OPTIONAL TOOLS
Third party tools
We may provide access to third party tools that we do not control. These tools are provided “as is” and “as available” without warranties. Your use of optional tools is at your own risk and subject to the third party’s terms.

The Services may contain links to third party websites or embedded functionality. We are not responsible for third party content, products, services, or policies. Accessing third party sites is at your own risk.
SECTION 10. RELATIONSHIP WITH SHOPIFY
ELYRA is powered by Shopify, which enables us to provide the Services. However, all purchases are made directly with ELYRA (Silverback Tribe), not Shopify. You acknowledge that Shopify is not responsible for any aspect of sales between you and ELYRA.
SECTION 11. PRIVACY
Personal information collected through the Services is handled according to our Privacy Policy [LINK]. Shopify may also process personal information to provide and improve the platform, as described in Shopify’s privacy documentation.
SECTION 12. FEEDBACK AND REVIEWS
If you submit feedback, reviews, suggestions, or other content, you grant us a worldwide, perpetual, sublicensable, royalty free license to use, reproduce, modify, publish, distribute, and display such content for operating and promoting the Services, unless prohibited by law.
You confirm you have the rights to submit the content and that it does not violate third party rights or laws. We may remove content that we believe is unlawful or inappropriate.
SECTION 13. ERRORS AND CORRECTIONS
We may correct typographical errors, inaccuracies, or omissions at any time, including after an order is submitted. If we change or cancel an order due to an error, we will attempt to notify you using the contact details provided.

Where liability cannot be excluded under applicable law, our liability will be limited to the maximum extent permitted by law, and in any case will not exceed the amount you paid for the relevant product or order giving rise to the claim.
Nothing in these Terms excludes or limits liability for
1 death or personal injury caused by negligence where such limitation is unlawful
2 fraud or fraudulent misrepresentation
3 any liability that cannot be excluded under applicable law

You agree to indemnify and hold harmless ELYRA, Silverback Tribe, Shopify, and our respective affiliates, officers, directors, employees, agents, and service providers from claims, losses, damages, liabilities, and reasonable legal fees arising out of

4 your misuse of the Services
SECTION 19. SEVERABILITY
If any provision is found unlawful or unenforceable, the remainder of the Terms will continue in effect.
SECTION 20. WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any right or provision is not a waiver. These Terms and referenced policies form the entire agreement between you and us regarding the Services.
SECTION 21. ASSIGNMENT
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, sale of assets, or by operation of law.
SECTION 22. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of The Netherlands, without regard to conflict of law principles.
If you are a consumer residing in the EU, UK, or another jurisdiction that grants mandatory consumer protections, you may also benefit from mandatory rights and may bring claims in the courts of your country of residence where required by law.
